Growing concerns regarding size, pedestrian safety, and river craft interference contributed to Boston University's decision to build a new and larger sailing pavilion in the Charles River Basin. Their proposed location would give the university control of almost 1.5 acres of land and water dominating the Charles River Esplanade. However, the selected open space is held in trust for the citizens of Massachusetts pursuant to Article 97 of the Amendments to the Massachusetts Constitution and would require an affirmative two-thirds vote of the Legislature.

As a result of concern expressed by the Charles River Watershed Association (CRWA) and other community groups, Boston University evaluated four alternative locations as directed by the Executive Office of Environmental Affairs Secretary. After reviewing the initial alternatives analysis, the CRWA, and others with whom they worked, felt strongly that an objective, independent analysis of site alternatives was required and commissioned Beals and Thomas to perform the analysis.

After review five alternative locations, Beals and Thomas concluded two locations were more notable in terms of protecting the public trust and avoiding or minimizing damage to the environment, as required under the Massachusetts Environmental Policy Act. Subsequently, in January 2002, the Secretary of Environmental Affairs, directed Boston University to reevaluate a preferred site.
